SMS Terms

1. Programs Covered

Clear Mornings runs two SMS messaging programs. These terms describe both. By using either program, you agree to these terms.

1.1 Account Verification (One-Time Codes)

When you sign up, sign in, or change your phone number, we send a one-time verification code (OTP) to confirm you own the number. Codes are valid for 5 minutes and used solely to verify phone ownership. They never include marketing content or links.

1.2 Trainer Communication (Optional)

If you connect with a Clear Mornings trainer, you may optionally enable SMS to receive workout reminders, program updates, check-ins, and direct replies from your trainer. Trainer SMS is opt-in only and can be disabled at any time from your account settings.

2. How You Opt In

2.1 Account Verification

You opt in by entering your phone number on the Clear Mornings sign-in or sign-up screen and tapping "Send code." The consent disclosure on that screen states:

"By continuing, you agree to receive a verification code via SMS from Clear Mornings. Up to 2 messages per login attempt. Msg & data rates may apply. Reply STOP to opt out or HELP for help."

Tapping "Send code" constitutes your express consent to receive a verification code at the number you entered.

2.2 Trainer Communication

If you have a trainer relationship, you separately opt in to trainer SMS through an in-app consent screen that appears the first time SMS is offered. You can also enable or disable trainer SMS in your account settings at any time.

3. Message Frequency

  • Account verification: Up to 2 messages per sign-in or sign-up attempt. We send verification codes only when you actively request one by tapping “Send code.”
  • Trainer communication: Frequency varies based on your interaction with your trainer and program activity. Typically a handful of messages per week.

4. Carrier Charges

Message and data rates may apply. Check with your mobile carrier for details about your plan's SMS charges. Carriers are not liable for delayed or undelivered messages.

5. How to Opt Out

  • Reply STOP to any Clear Mornings SMS message to immediately unsubscribe from that program. You will receive one final confirmation that you have been unsubscribed.
  • Reply HELP to receive support information and instructions for contacting us.
  • You can also revoke SMS consent at any time from your account settings inside the Clear Mornings app.
  • Opting out of trainer SMS does not affect account verification messages, which are sent only when you actively request a sign-in or sign-up code.

6. SMS Service Provider

We use Twilio Inc. as our SMS service provider to deliver messages on our behalf. Twilio processes your phone number and message content solely to transmit SMS and is contractually prohibited from using this data for any other purpose.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging opt-in data and consent are never shared with any third party.

7. Privacy

Our handling of phone numbers, message content, and opt-in/opt-out records is described in our Privacy Policy. Section 13 of that policy is dedicated to SMS-specific data practices.

8. Eligibility

Clear Mornings SMS programs are available to mobile phone numbers in the United States. By opting in, you confirm that you are the account holder of the mobile number you provided or have authorization from the account holder to receive SMS messages at that number.

9. Changes to These Terms

We may update these SMS Terms from time to time. Material changes will be communicated via SMS, email, or in-app notification before they take effect. Continued use of the SMS programs after changes indicates acceptance.
